Consumer Court Procedure in Bangalore

Hello,

Is anybody familiar with the process of registering a case with the consumer court in Bangalore? Where to go, what documents are needed, what are the charges...

I recently purchased a dining table + 6 chairs from Ood Life in Phoenix Mall. The items were on sale and we inspected it thoroughly before putting our money down. However, when they were delivered to our place, it had several chips and scratches. The sales folk accepted that the damage would have happened in transit. We asked them for a refund to which they (the Mumbai head office ) are now refusing stating the purchase was made during the sale. They say they can give me a credit note instead :mad: What the **** would I do with a 70K credit note to a furniture shop??? The sales guys are offering to refund the money in case they manage to sell the items to some one else...

I really feel I'm well within my rights to demand a refund as the damage has occurred after I made the purchase. They cannot hold the customer responsible for that!!!
 
I do not know about Bangalore but I guess procedures should be same everywhere in India.

You should visit the local consumer court. The lawyers can draft your complaint for about Rs 3000. You can also write a complaint on a piece of paper and submit it. Include the local shop from where you purchased as well as their head office.

Then the court would send notice to them and proceedings can begin.

Though you can hire a lawyer its not required. Arguing in a consumer court is very easy.
 
Thanks. As of today the latest update is that they have agreed to refund the money by Monday/Tuesday...so hopefully I won't have to go the legal route...

I got a cheque from the store a few days back. Need to deposit it yet...

Thats great news. In an ideal world where buyers and Sellers both are understanding consumer courts shouldnt be required!

This is so true but only for the like minded and positive people. Sadly consumers are literally forced to go the Consumer Court route in some cases which can be settled amicably; saving the time and effort on both ends and the company's/ shops name does not get tainted and tarnished too.:)

Well...what do you know...the cheque bounced!!!

I spoke to the guy last week...he was apparently 'out of town' and was scheduled to return 2 days ago. I called him today and he continues to be 'out of town' till Monday. Will wait...
 
Alright...update time...

After nearly 4 months of constant follow-ups, several phone calls, 2 bounced cheque and 1 'official' notice later I finally managed to get my money back in 2 easy interest-free installments.

The manager had been 'moved' to the Chennai branch and for some reason he chose to keep changing his phone number every 2 weeks...he transferred 50K a couple of weeks back and handed me the balance in cash this Saturday. I suspect the balance was paid since I landed up at their showroom precisely at the moment when he was 'visiting' and was distracted by a phone call and could not notice me approaching.

It turned out that he had sold the items to another customer and pocketed the money...and repaid me at his convinience. Also noticed his swanky new iPhone...wonder where he got the money for that from???

Net-net...I got my money back and ended up a wee bit wiser...

I wondered if an item was bought from a seller in Mumbai, would I have to go to consumer court there or can I file in Bangalore please? I cannot share this incident, but the seller has sold me what could be a fake. Although the item was shipped from Mumbai after full payment, I never took delivery and it is back in the warehouse of the seller. However the seller says that he/she has paid another party for the item and therefore cannot refund the money until the item is sold. This was eight months ago and it looks like they may have a hard time selling it. This could get complicated and may involve expert witnesses etc. Thanks.

You could have initiated action under section 138 of Negotiable Instruments Act for dishonour of cheque and a money suit to recover the amount paid by you.

Normally the invoice will contain a jurisdiction clause, restricting you to approach the concerned district consumer forum.
