The following is the summary of my ordeal while dealing with Panasonic India.

-Wanted to buy a 50VT20D plasma television from Gurgaon.
-Contacted Dawar's Open World in Gurgaon where in Ms. Ashima & Mr. Rana quoted Rs 77000 for an unused, box packed 50VT20D with 2 3D glasses.
-Visited Dawar's Open World yesterday with my family. Paid and bought the plasma TV after paying.
-Mr. Rana, Ms. Ashima, and Ms. Meena said that new piece is available at the -warehouse and since it is late at night, it will be delivered next day.
- Ms. Meena had a very rude behavior while dealing. Mr. Rana apologized on her behalf and helped us to close the deal.
- Promised delivery time was 12:30 p.m. After repeated followups, the TV was delivered at 6:30 p.m. at my residence.
- Upon opening the piece, I could saw some scratch marks at the back of the TV. On inquiring, the delivery Boys from Dawar's Open World and the Panasonic Service Engineer present said that these are normal and are caused by packing.
- Upon switching on the plasma, to my shock, the service menu stated that the plasma has been used for about 69 hours and 45 minutes and has been switched on/off at least 240 times. (picture available).
-Also one 3D glass was delivered in place of 2 promised.
-The delivery boys had left by that time, but the service engineer was still at my home, who confirmed that it is a used piece.
-I then spoke with Panasonics customer service manager Mr. Sanjeev Sharma and apprised him of the situation. He asked me to wait for 10 minutes.
-I called up Dawars open world and spoke with Mr. Rana who said that even if it is a used piece I should not be having any problem.
-I said that I wont accept a used piece after paying in full. He then gave the phone to his service manager who requested me to wait till tomorrow morning by which he can provide a replacement and the extra 3d glass. Ms. Meena on phone said they have 1.5 crore worth of displays in their showroom of Panasonic, and Panasonic has entitled them for selling display panels and used plasmas.
-I got a call from Mr. Sanjeev Sharma who told another story by saying that Dawar people are claiming that they committed selling a used plasma so my complaint is null and void and advised me to speak to a certin Mr. Sindhwani, supposedly branch head of Haryana region.
-Spoken with Mr. Sindhwani, he was rude and indifferent in his behavior and tried to impose what Dawar people are stating.
-Spoken with Dawar people again. Their service manager said he can't help till next morning and gave me the number of Mr, Dawar.
-Spoken with Mr. Dawar, he said that they have sold me a used piece as agreed. and asked me to do whatever I can.
-Spoken with Mr. Sanjeev Sharma again, who said that only dealer can help and panasonic can't.

Please advice how do I take this forward.

-I've a bill available with me which clearly states that it is not a display panel but a fresh piece which is shipped from the godown of Dawar's Open World.
-Moreover, the plasma in financed by Bajaj Finserv Lending, which itself doesn't finances used products.
-In addition to it, the plasma has a warranty card. I wonder whether used plasmas came with a warranty.

Surprise to note that Panasonic India Officials and Dawar claiming that in Rs 77000 one can get a used 50VT20D only.

Please let me know a good consumer lawyer number as well. Panasonic can't take us for granted like this.

And stay away from Dawars Open World.

Has anyone agreed on paper that a used piece was delivered? Get that thing on paper first.
As the days go by, they may say that a new piece was delivered and whatever usage hours are shown are used by yourself. ? I don't know how to deal with this but get at least this step right.

Legal proof could be the pictures showing the service menu and the hours used. The pictures timestamp correspond to the delivery time. Clicked panasonic's service engineer's photo as well with the TV. Lodged a complaint promptly at Panasonic customer care helpline. Complaint number available. Also emailed to panasonic customer care and bajaj finserve lending customer care along with the photograph.

1st of all you should have the proofs intact. While photographs are a good option video would be even better. Make a video showing usage hours of TV and immediately shift to news channels so that you can later prove in court that on a particular date the tv had already been used for X no. of hours which can only be possible if it has been used before it was delivered to you.

After that you can file a case in consumer court. It looks like an open and shut case but you never know what might happen in court. I suggest you always accompany your lawyer.

You can write Panasonic India service and lodged complaint at media and tv where several programs runs on consumer complaints .
Pehredar on tv18 and many more .
You can also go to consumer court if your purchase valid for fresh tv .

already written to panasonic india and bajaj finserve lending.
Requesting to help me out with email ids of higher ups in panasonic india, japan and global.

Is there any way you an stop the EMIs to Bajaj Finserve, in turn asking them to get payment back from Dawars? Only money speaks. Since Dawars have taken 77K from you, they will not care for all your screaming. Just shift the cards to the other table. Send a long letter to Bajaj Finance, and tell them you are stopping payment for being cheated by Dawars and that they should file a case against Dawars for delivering a used piece when Bajaj Finserve does not finance used pieces.

Cheers

It is a well known fact amongst a lot of us, that 'Dawars Open World' is a dishonest company. I know of numerous cases regarding their dishonest ways of doing business. No one should do business with them, i.e., unless they like being cheated. Anyhow, in your position there aren't too many options for you. I would suggest that you register your complaint, in full detail, with Panasonic Japan and Panasonic India. Make sure your complaint is in writing, an email will suffice. By the way, you do not need a lawyer to file a complaint in consumer court.

PS: This forum needs a sticky thread with a list of dishonest retailers. I think that would be the most helpful thread for most.

I think venkat has given a good suggestion and also sanjay's option is good that we post a sticky thread so that we post in specific formats like FRAUD XXX delaer such that in ghoogle search the dealer names pulls the fraud term with it.

Moderators, as suggested by Sanjay, a list of those dishonest retailers will be really helpful... Plz think of it.

Sorry to hear that. But wondering why you still stayed there. You could have simply walked away.

Right, because I was dealing with Mr. Rana and he was courteous at that time. I should have got the drift by Meena's behavior and walked off.
Meanwhile Dawars open world has agreed to refund in full through a cheque.
I requested them to do a NEFT or issue a DD/Banker's cheque, but a delivery boy has already left their showroom with the cheque.
They are assuring me that the cheque will not bounce. Any precautions to be taken here?

Requesting any Delhi member who bought this plasma from Croma around 71k including 2 glasses, keyboard, hdpvr to share invoice number so that I can get the same deal.

Sorry to hear about the ordeal you are going thru..

You can go ahead and accept the cheque. Legally they are liable to honour the cheque and if it bounces then they are in a bigger soup under the Negotiable Instruments Act. I do not think any business will dishonour the cheque as it will effect there future business. In worst circumstances if the cheque bounces then you have more legal teeth to nail them more so..

Hope it gets resolved for your satisfaction..

Thanks..
